These Terms and Conditions apply to the sweepstakes conducted by theCafé Intenciónbrand, owned by J.J. Darboven GmbH & Co. KG, Pinkertweg 13 - 22113 Hamburg (hereinafter referred to as the “Organizer”). Participation in the sweepstakes is governed exclusively by these terms and conditions. The sweepstakes is in no way affiliated withInstagramand is not organized or sponsored byInstagram in any way.
1) Duration of the Contest
The contest runsfrom October 1, 2024, through October 6, 2024, at 11:59 p.m. During this period, users will have the opportunity to enter the contest online.
2) Contest Procedure
To enter, participants must leavea comment under the giveaway post on the @cafeintencion Instagram channeland agree to these terms and conditions.
Participation is only possible during the entry period. Entries received after the entry deadline will not be considered in the drawing.
Only one submitted entry per participant will be considered for the contest. It is prohibited to use multiple accounts to increase the chances of winning. Participation in the contest is free of charge.
3) Eligibility
Eligible to participate are individuals who are residents of Germany and have reached the age of 18. Participation is not limited to customers of the organizer and is not contingent upon the purchase of any goods or services.
If a participant’s legal capacity is limited, the consent of their legal representative is required.
All persons involved in the design and implementation of the contest, as well as employees of the organizer and their family members, are ineligible to participate in the contest. Furthermore, the organizer reserves the right, at its sole discretion, to exclude individuals from participation if there are valid reasons to do so, such as:
(a)in the event of manipulation related to access to or the conduct of the contest,
(b)in the event of violations of these Terms and Conditions,
(c)in the event of unfair practices or
(d) in the event of false or misleading information related to participation in the contest.
4) Prize, Notification, and Delivery of the Prize
The contest includes three prize packages containing the following:
- 1x Café Intención Country Coffee: Honduras
- 1x Café Intención Single-Origin Coffee from Peru
- 1x Café Intención wooden box
Winners will be determined after the entry deadline througha random drawing from among all participants.
Winners will be notified promptly via Instagram Direct Messages.
The winner must contact Café Intención via Direct Message within 24 hours. If a winner does not contact us within this time frame, the organizer may transfer the prize to another participant.
The prize will be delivered by package mail at the organizer’s expense exclusively to the winner or the winner’s legal representative. Exchanges, in-person pickup, and cash redemption of the prize are not permitted. Any costs associated with claiming the prize (travel, etc.) are the responsibility of the winner.
5) Early Termination of the Contest
The organizer reserves the right to cancel or terminate the contest at any time without prior notice and without stating reasons. The organizer will exercise this right in particular if, for technical reasons (e.g., viruses in the computer system, tampering, or errors in the hardware and/or software) or for legal reasons, the proper conduct of the contest cannot be guaranteed. If such termination is caused by the conduct of a participant, the organizer may seek reimbursement from that person for any damages incurred.
6) Data Protection
Providing personal data is required to participate in the contest.If the participant enters the contest using a username (which he or she has chosen on a social media platform), their personal data will be requested if that participant wins. .
The participant warrants that the personal information provided by him or her—in particular, first name, last name, address, and email address—is truthful and accurate.
The organizer notes that none of the participant’s personal data will be disclosed to third parties or made available to them for use. Exceptions are made for shipping service providers if a prize must be sent to participants by mail.
All email addresses and any data voluntarily provided by participants will be collected and stored solely for the purpose of determining the winners. All data will be deleted no later than 30 days after the end of the contest. Participants are entitled to their statutory rights of access, correction, and withdrawal. 7) Withdrawal
Participants are free at any time to request the deletion of their registration data by sending a request tocafeintencion-socialmedia@darboven.com, thereby withdrawing from participation.
8) Liability
Claims regarding any material defects and/or legal defects in the prizes donated by the prize sponsors must be asserted exclusively against said sponsors. The organizer is not liable for the insolvency of a prize sponsor or for any consequences resulting therefrom for the conduct of the contest.
The organizer is not liable for the entries submitted by participants in connection with their participation in the contest.
The organizer notes that the promotion may be terminated or a post or posts may be removed due to external circumstances and constraints, without this giving rise to any claims by participants against the organizer.
The organizer is liable only for damages caused by the organizer, its legal representatives, or vicarious agents through willful misconduct, gross negligence, or a breach of material contractual obligations in connection with the conduct of the contest.
In the event of a breach of material contractual obligations, the organizer is liable only for foreseeable damages typical for this type of contract. Material contractual obligations are those whose fulfillment is necessary to achieve the purpose of the promotion and on whose compliance participants may reasonably rely. Liability for damages resulting from injury to life, limb, or health remains unaffected.

10) Severability Clause
Should any provision of these Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
